There Is No Storage Of Items Over 7 Days Under Any Circumstance Due To The Nature Of The Sale It is highly encouraged that bidders inspect all lots prior to bidding, send an agent or contact the auction company for detailed photos. TERMS AND CONDITIONS OF SALE The conditions set forth below constitute the terms and conditions on which all property is offered for sale. Bidding at auction, whether present, by absentee bid or online, the buyer agrees to be bound by these terms. Your bid is a contract. Bidders are required to register with proper identification prior to the sale and must use the number issued to them when they are the successful bidder. *** BIDDER APPROVAL IS AT THE SOLE DISCRETION OF HAMILTON GROUP AND THE TRUSTEE. TRUSTEE HAS THE RIGHT TO WITHDRAW ANY ITEM PRIOR TO THE CLOSING BID ON ANY ITEM. All items are sold to the highest bidder subject to a starting bid. The auctioneer or trustee has the right to reject any bid. Should there be any dispute after sale, the record of final sale shall be conclusive. All sales are final. If the top bidder defaults on any lot the backup bidder would be given the option to purchase the lot at their last recorded bid. Prospective bidders should consult the bid increment scale to ensure their bids conform to our printed bidding increments. The auctioneer reserves the right to withdraw any lot before or at the sale. A 15% a buyer's premium will be added to the hammer price of each lot sold though Liveauctioneers in our ONLINE sales. 3% Credit Card Processing Fee is added when paying with a credit card. Wire Transfers and Bank Check will be accepted with no additional costs. Buyers are required to pay sales tax on the total sales price, including the buyer's premium. All purchases are subject to the Connecticut Tax of 6.35% or their state tax rate unless the purchaser possesses a Tax Exemption Number or an out of state tax number that shows they are a reseller of the type of goods purchased. All invoiced must be paid in full before any items are released no partial payments on select items allowed. The purchaser is legally responsible for payment. Payment must be made in full by February 16th, 2021 of purchase or your credit card on file will be charged. Payments accepted are Cash (In House Only), Bank Certified Chek, Bank Wire Transfers, and Credit Cards. No Personal Checks Accepted. Items Must be removed by February 20th, 2021. Detailed condition reports are not included in this catalogue. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. It is the responsibility of prospective bidders to examine lots in person, through an agent or by contacting the gallery. All counts, weights and measurements are approximate. Any mechanical devices are assumed not in working order unless otherwise stated. The Auction House shall bear no responsibility for any error or omission. Only rely on the catalog or statements as guides not statements of authenticity of fact, all measurements are approximate. HAMILTON GROUP will not ship items. Buyers may utilize a third party shipper, the Hamilton Group may list options for shippers but we do not endorse any one in particular. However the local UPS Store In Clinton, CT will be the default shipper unless we are notified by email that the buyer wants to use another party. All items must be picked up, or shipping arrangements made, by Saturday February 20th, 2021. All bidders must email (mike@hamilton-grp.com), call (860-552-4609) or fax (203-643-2285) notification back to HAMILTON GROUP regarding their chosen shipper. Pick-up times are Sunday 2/14 through Saturday February 20th, 2021 between 9AM and 4:30PM by appointment only. The purchaser must pay the shipper in advance for all packaging expenses, including labor, materials, postage, and, if applicable, insurance fees. Please be aware that framed works of art are costly to pack/ship, it is not uncommon for the price of packing/shipping to exceed the purchase price. Returns will NOT be accepted as a result of packing/shipping costs. We will not be held responsible for choosing a shipper in the event of any act and/or omissions in packing. We do not assume responsibility for damages. Regardless of shipping method, auction house must have received cleared funds to release property. Buyer must provide gallery with signed authorization for release of the property that states your name, sale date, lot number and choice of carrier. The seller shall assume NO RESPONSIBILITY for damage or loss by the shipper, i.e. UPS, USPS, FEDEX, DHL, etc. If a loss or damage should occur during shipment, it is incumbent upon the buyer to file for recovery of any losses incurred. Under no circumstances can the claim exceed the hammer price (not including the buyer's premium). PLEASE NOTE: Shippers refuse to acknowledge the buyer's premium as a requisite part of the sale amount. Unless otherwise stated all artwork sold by Hamilton Group, LLC is assumed either "after," "school of," "circle of" or "manner of" and will carry no warranties or guarantees as to authorship or authenticity weather stated or implied by any other parts of this agreement. Ignorance of the terms is no basis for any action towards HAMILTON GROUP AND THE TRUSTEE or their consignors. YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. ANY BIDDER WHO FAILS TO CONSUMMATE A PURCHASER WILL BE BANNED FROM BIDDING AT ALL FUTURE SELLER AUCTION EVENTS AND MAY BE PURSUED FOR CIVIL AND/OR CRIMINAL VIOLATIONS.
