READ THIS ~ IT’S IMPORTANT! ALL BIDDERS ACKNOWLEDGE AND AGREE TO THE TERMS & CONDITIONS OF THIS AUCTION & THE FOLLOWING TERMS SHALL APPLY AT ALL TIMES TO THE CONDUCT OF THIS AUCTION. Any bid in the auction automatically constitutes acceptance by the bidder. 1. The auction is conducted in accordance with the regulations of the State of California. 2. All lots may at American Auction Co’s, sole discretion carry a reserve. Auctioneer will bid on behalf of consignor’s reserves/minimums, if any. 3. All lots will be sold to the highest bidder as determined by the auctioneer. 4. Any announcements made on auction day take precedent over any terms that may be contained in this catalog and/or other announcements and/or documentation. 5. Buyers Premium: All items sold via the Internet shall be subject to a Buyers Premium of 17% which will be charged on the final auction price of each lot. A $5.00 handling fee will be charged for each successful Internet item to cover shipping material etc. 6. Bid Rejection American Auction Co. reserves the right to reject any bid for any reason. 7. Duplicate High Bids In the case duplicate bids are received the earliest received bid will be the winning bid. 8. DISPUTES: In the case of any disputes arising during the course of this auction the auctioneer's decision shall be final and binding. 9. SALES TAX: California State Sales tax (7.25%)shall be collected on all in-state purchases unless a current resale certificate is on file with American Auction Co. 10. PAYMENT: Payment is due immediately upon receipt of notification and payment is deemed delinquent, and in default if not made in good funds in full within ten (10) of email notification of winning bid. Accounts not settled within 30 days of the sale will be subject to forfeiture of all deposits and loss of title to the property. See payment instruction section for further. 11. GUARANTEES OF AUTHENTICITY: American Auction Co. endeavors to accurately describe all of the items being auctioned, however, all property is sold “as-is”, “where-is”. No statement in this catalog, bill of sale, invoice, or advertisement by American Auction Co., or any individual in the employ of American Auction Co. will assume any responsibility or liability with respect to age, condition, size, quality, rarity, grade, variety, importance, historical relevance, or value of any of the items being auctioned. American Auction Co. accepts consignor's descriptions and estimates values for identification purposes only. "No warranty of merchantability or fitness for a particular purpose is made or implied on any lot in this auction, and no warranty, whether expressed or implied, is made with respect to any lot except for a warranty of title; it being understood that the purchaser consequently assumes all risks concerning and related to the grading, quality, description, condition, authenticity and provenance of a given lot. 12. Title: Title to all items shall be passed to the successful bidder once the auctioneer says “SOLD”. The purchaser shall assume full responsibility for the lot purchased once the title has passed. 13. SHIPPING OF MERCHANDISE: Only successful bidders are contacted. AMERICAN AUCTION CO. WILL NOTIFY WINNING BIDDERS VIA EMAIL ON TUESDAY MORNING (Not Sunday, not Monday). Be patient as we must make numerous notifications and handle large volume of shipping, please be patient. Any buyer may, and in the case of oversize un-shippable items MUST make their own arrangements for freight/shipping and/or pick-up. USPS Priority Mail will be used for shipping. Winning bidders not wishing to utilize USPS Priority Mail must make their own arrangements for shipping. 14. REFUND POLICY: Absolutely "no refunds", "no exchanges", "no returns accepted". It is the buyers responsibility to ensure his/her intention and knowledge in the bidding process as well as the condition of any item of interest and upon awarding the winning bid accepts all fiduciary responsibility without question. No refunds, no exchanges, no returns -Personal inspection of auction items is highly recommended. 15. Absentee/Phone Bids Absentee/phone/email bids (email via amauctionco@aol.com only) will be accepted until Saturday 8 P.M. the night before the auction. Telephone bids can be accepted during the auction only on an outgoing basis. Arrangements must be made prior to the auction for live phone bidding.
