FINE JEWELRY LIQUIDATIONS

The Terms and Conditions defined by FIFTH AVENUE JEWELS are an irrevocable contract between bidders, winning bidders, and FIFTH AVENUE JEWELS. Upon participating in our auctions, bidders are hereby compelled to accept and comply with all TERMS AND CONDITIONS established by FIFTH AVENUE JEWELS. There are strictly no returns, no exchanges, and no credit sales. All sales are final. All items are sold as is. IT IS THE BIDDERS' SOLE RESPONSIBILITY TO VERIFY THE VERACITY OF PIECES PRIOR TO PLACING A BID. IN SPECIAL CASES WHERE ARE RETURN IS ACCEPTED, THE AUCTION HOUSE WILL DEDUCT a 15% RESTOCKING FEE. BOTH AUCTION PREMIUM AND SHIPPING FEES ARE NON-REFUNDABLE. Information tendered by the auction house in the listing is merely for the convenience of the buyer. It is solely the bidders' responsibility to ascertain, check, inspect, and firmly decide prior to placing a bid. All aspects of a piece?s condition, state, realness, and efficacy shall be verified by the buyer. FIFTH AVENUE JEWELS does not provide any guarantee as to salability and conditions of lot relating to the item's market value. FIFTH AVENUE JEWELS has the right to accept or reject a bid for any reasons whatsoever. Prior to bidding on a piece, a bidder can contact and coordinate with the auction house either by email at HEENA@HMIJEWELRY.COM or through our customer service phone line. All sales are final and bidders should have no objection after the sale closed. All lots are sold "AS IS" without any recourse. Pictures and descriptions shall only come with an implied warranty of merchantability, without any guarantees or assurances. The Buyer?s Premium will be 20% of HAMMER PRICE (AN ADDITIONAL FEE WILL BE ASSESSED FOR EACH WINNING ITEM). FOR CANCELLATIONS OF WINNING ITEM, THERE SHALL BE A CHARGE OF 20% OF THE HAMMER PRICE. TESTING OF BIDS IS PROHIBITED. The Auction house does not have the ability to remove bids. FIFTH AVENUE JEWELS will not be responsible for any bid testing, internet failures, power outages, or any interruptions or technical errors occurred before, during and after the sale is closed. The Auction house must receive full payment before any items are shipped. The buyer should expect to receive the item within 7 to 10 business days following our receipt of payment. Please note that for credit card payments, the bidder agrees that no chargeback is to be filed against FIFTH AVENUE JEWELS. Bidder waives his/her right to file a claim, chargeback, or payment dispute. FIFTH AVENUE JEWELS select the bidders to join the auction and not all bidders who want to join are guaranteed acceptance into the auction. FIFTH AVENUE JEWELS only accepts money orders and cashier's check for payment. For bidders who opt for a credit card payment, they shall indemnify FIFTH AVENUE JEWELS against any liability for chargebacks. In the event that a chargeback is filed, the bidder shall be liable to pay an additional $100 chargeback settlement fee. All disputes should be settled between the bidder and FIFTH AVENUE JEWELS, without the involvement of a third party or credit card institution. To prevent disputes, it is the bidders' responsibility to verify the item before placing a bid and accepting the condition that all sales of FIFTH AVENUE JEWELS merchandise through the Auction house are final.
