Conditions of Sale 1. There is a 15% buyer's premium added to the hammer price of every lot, which is to be paid by the purchaser of that lot. Lots purchased online through eBayliveauctions.com are subject to an additional 5% buyer's premium (20% total) added to the hammer price. Connecticut sales tax is not charged on the buyer's premium. 2. All sales are subject to a Connecticut sales tax of 6 % unless the purchaser provides the auction house with a valid resale certificate exempting him from payment of the tax, or if the purchaser is from outside of Connecticut and has the purchase shipped outside of the state. 3. We make every effort to correctly describe the property to be sold. However, all items are sold "as is" and "where is." Hamilton Auction Galleries (hereinafter referred to as Hamilton's) disclaims any express or implied warranties or guarantees as to the condition or authenticity of items sold. All representations made by Hamilton's are done to the best of our opinion and should be considered statements of opinion and not relied upon as statements of fact. Photographic images of items being offered, whether provided in print or online, as well as references in the catalog entry or condition report to damage or restoration are for guidance only. The absence of a reference does not imply that an item is free from defect or restoration, nor does a reference to particular defects imply the absence of any others. Items being offered should be evaluated by personal inspection by the bidder or a knowledgeable representative and the purchaser is fully responsible for determining authorship and condition of the work. Neither Hamilton's nor its consignors are responsible in any way for errors and omissions in the catalog, or any supplemental material. All sales are considered final with the following exception: Hamilton's will agree to a refund of the purchase price if within twenty-one (21) days of purchase, the purchaser obtains a written letter from a recognized expert or authority on the artist stating unequivocally that the work is a forgery or not by the represented artist. The choice of expert or authority must be mutually agreeable to Hamilton's and the purchaser. This exception will only apply to a work signed by the artist and not to an attribution, manner of, school of, circle of, or follower of a particular artist. The letter must be signed and on letterhead of the recognized expert or authority. Any exceptions to this rule must be specifically approved by Hamilton's. 4. Merchandise purchased must be paid for and removed within five (5) days of the sale. Hamilton's may charge a monthly fee of one percent (1%) of the purchase price for lots not removed after five days. 5. Hamilton's is under no obligation, but may agree, to assist purchaser in arranging for packaging and shipping an item at the request of the purchaser. The purchaser agrees that packaging, shipping and handling is the absolute risk of the purchaser. Purchaser will pay all costs including, but not limited to, the handling and insurance associated with shipping. Hamilton's will be held harmless from any claim, and all rights of subrogation from an insurance carrier are waived against Hamilton's. Purchaser releases Hamilton's from any responsibility for damages, lost or stolen items, and from liabilities resulting from any lack of restitution from shippers. 6. Many items in the auction are sold subject to a reserve. Such reserve is confidential, but in no case will the reserve exceed the low estimate. The auctioneer may reject any bid or increment not commensurate with the value of the lot. 7. Hamilton's retains the right to withdraw any item from the sale before or during the auction. 8. In the event of a dispute, the auctioneer has the sole authority to determine the successful bidder, or to re-auction the item in question. His discretion is absolute. 9. Payment may be in the form of cash, personal check, or bank check. Hamilton's has the right to hold merchandise if paid for by personal check until such time as the check has cleared. 10. We will use reasonable efforts to carry out written bids delivered to us prior to the sale for the convenience of clients who are not present at the auction in person, by an agent or by telephone. If we receive written bids on the lot, it will be sold to the person whose written bid was received and accepted first providing the bids equal. Execution of written bids is a free service undertaken subject to other commitments at the time of the sale, and we do not accept liability for failing to execute a written bid or for errors and omissions in connection with it. With regards to telephone bids, if a prospective buyer makes arrangements with us prior to the sale we will use reasonable efforts to contact him to enable him to participate in the bidding by telephone, but we do not accept liability for failure to do so nor for errors and omissions in connection with telephone bidding. 11.Hamilton's reserves the right to change the terms of the sale by verbal agreement, and these changes shall constitute changes to the terms and conditions. BIDDING AT THIS AUCTION, WHETHER IN PERSON, BY AGENT, ORDER BID, TELEPHONE OR OTHER MEANS, CONSTITUTES YOUR ACKNOWLEDGEMENT AND ACCEPTANCE OF THESE "CONDITIONS OF SALE" AS LISTED ABOVE.
