Bidder acknowledges and agrees that all property is sold "AS IS" - "WHERE IS", and AA Imports LTD. makes no warranties representations on merchantability, correctness of the catalogue or other description of the physical condition, size, quality, color finish rarity, importance, medium, material, genuineness, attribution, provenance, period, culture, source, origin, exhibitions, literature or historical significance /relevance of the property auctioned and sold. The absence of any reference to the condition of a lot does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging. All sizes listed are approximate. BIDDERS ARE ADVISED BY AA IMPORTS TO CAREFULLY INSPECT THE PROPERTY BEFORE PLACING A BID. ALL SALES ARE FINAL! AA Imports LTD makes no warranty or representation, express or implied that the purchaser will acquire any copyright or reproduction rights to any lot sold. Some goods or lots may be subject to reserve prices set by AA Imports LTD. AA Imports LTD shall have full discretion to refuse any bidding, to divide any lot, to combine any two or more lots and to withdraw any lot prior to taking bids on said lot. AA Imports LTD is not responsible for any errors or omissions in connection with such pre-auction, order bids, transfer of rights or obligations with respect to purchase at the auction shall be valid; and all purchases are subject to the collection of California sales tax in the amount of (9.5%) from the successful bidder unless the successful bidder is exempt under California law. A range of estimates is given on each auction lot with a low and a high estimate. Estimates should not be relied upon as a prediction of the actual selling price, appraised value, or retail value of the lot. By participating in any sale, you acknowledge that you are bound by these terms and conditions. AA Imports reserve the right to withdraw any property before the sale. Any further questions of a prospective internet bidder need to be addressed prior to bidding and a complete set of terms and conditions of sale will be sent for your review. We are happy to help you on the telephone or via e-mail with condition reports or any other information. We DO NOT accept the return or refunds of items purchased. Viewing lot option is available 5 business days prior to auction date by appointment (855) 765-5800. Placing a bid: Prospective buyer may/may not complete and sign a registration form and provide identification before bidding. AA Imports LTD has the right, at our complete discretion, to refuse admission to the premises or participation in any auction and to reject any bid. When placing a bid, a bidder is accepting personal liability to pay the purchase price, including the buyer's premium, all applicable taxes and all other applicable charges, unless it has been explicitly agreed upon in writing with AA Imports LTD before the commencement of the sale that the bidder is acting as agent on behalf of an identified third party acceptable to AA Imports and that AA Imports LTD will only look to the principal for payment. The highest bidder acknowledged by the auctioneer will be the purchaser and A) assumes full risk and responsibility for loss of such goods, thereof, but not limited to, insurance, fire, theft, removal and storage or damage from any and all causes and B) will pay full purchase price thereof. In addition to the hammer price, the buyer agrees to pay AA Imports LTD, a buyer's premium and the applicable sales tax added to the final total. Payment: Winning bidder/ buyer herewith irrevocably promises to pay to AA Imports LTD. before the close of the auction at which a purchase is made the full purchase the online auctioneer for each article of property purchased by Bidder plus a "Buyer's Premium" of (5%) of such purchase price. All payments shall be in U.S. dollars. Purchases may be paid for with cash, personal check, company check, and bank wire transfer, MasterCard or Visa. If paying by check, AA Imports LTD. reserves the right to hold all purchases until the check has cleared to the satisfaction of AA Imports LTD and its bank. The buyer must pay the entire amount due (including the hammer price, buyer's premium, all applicable taxes and other charges) no later than 5 p.m. on the seventh (7th) business day following the sale, unless other arrangements are made with AA Imports LTD. If we do not receive payment in full, in good cleared funds, within seven (7) business days following the sale, we are entitled in our absolute discretion to exercise one or more of the following measures, in addition to any additional actions available to us by law: a.) to impose a late charge of one and a half percent (1.5%) per thirty (30) days of the total purchase price b.) to hold the defaulting buyer liable for the total amount due and to begin legal proceedings for its recovery together with interest, legal fees and costs to the fullest extent permitted by applicable law c.) to cancel the sale d.) to resell the property publicly or privately with such terms as we find appropriate, to resell the property at public auction without reserve, and with the purchaser liable for any deficiency, cost, including handling charges, the expenses of both sales, our commission on both sales at our regular rate, all other charges due hereunder and incidental damages. In addition, a defaulting purchaser will be deemed to have granted us a security interest in, and we may retain as collateral security for such purchaser's obligations to us, any property in our possession owned by such purchaser. At our option, payment will not be deemed to have been made in full until we have collected funds represented by checks, or in the case of bank or cashier's checks, we have confirmed their authenticity. e.) to offset against any amount owed f.) to not allow any bids at any upcoming auction by or on behalf of the buyer g.) to take other action as we find necessary or appropriate. A handling charge of $50 will be charged in addition for any check dishonored by the drawee. Once AA Imports LTD. has received all funds due to us, the buyer shall collect purchased lots within seven (7) business days from the date of the sale. AA Imports LTD. shall have the right to retain possession of all goods purchased by Bidder until AA Imports LTD shall be paid in full for all purchases made by Bidder. Accordingly, Bidder shall not be entitled to receive possession of any item until all items are paid for in full. Shipping: Shipping is the responsibility of the purchaser. Upon request, our staff will provide the list of shippers who deliver to destinations within the United States. We will not be responsible for the acts or omissions of carriers or third party packers whether or not recommended by us. Property will not be released to the shipper without the buyer's written consent and until payment has been made in full. Packing services of purchased lots can be provided by AA Imports LTD upon request. A price quote will be giving for packing and includes crating and blanket wrapping. Some property that is sold at auction can be subject to laws governing export from the U.S., such as items that include material from some endangered species. Import restrictions from foreign countries are subject to these same governing laws. Granting of licensing for import or export of goods from local authorities is the sole responsibility of the buyer. Denial or delay of licensing will not constitute cancellation or delay in payment for the total purchase price of these lots. If winning lot is to be picked up at our location: If property is not picked up within seven (7th) business days following the sale/ auction, whether or not payment has been made, AA Imports LTD. reserves the right to charge $5 per lot per day or to deliver said property to a public warehouse for storage at the purchaser's expense. AA Imports LTD shall have no liability for any damage to property left on its premises for more than seven (7) business days following the sale. In addition, we reserve the right to impose a late charge of one and a half percent (1.5%) per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. For property that is not picked up after thirty (30) calendar days, an additional administration fee of $75 will be charged. Property which is paid for but left on our premises for any reason in excess of sixty (60) calendar days is subject to sale by us or with any other auction house, with the balance of any funds recovered in excess of storage charges and any other fees being remitted to you. Purchased Lots - If for any reason a purchased lot cannot be delivered in the same condition as at the time of sale, or should any purchased lot be stolen, mis-delivered or lost prior to delivery, AA Imports LTD. shall not be liable for any amount in excess of that paid by the purchaser. Bidding on merchandise automatically constitutes agreement with these terms.
