CLE Art is acting as an agent of the seller in an online auction event and although every effort is made to provide accurate information, such information is provided as a convenience only and should not be relied upon by any bidder or Buyer and is not responsible for acts, omissions or representation of the seller on any of the seller's principals, officers, directors, employees or other agents. By placing a bid on an item(s), the bidder represents, warrants and understands that it has the authority and capacity to enter such a bid and close the transaction. Any bid that is made constitutes an irrevocable offer to buy the item(s) in question for the full bid amount, plus stated fees and any local or state taxes. A legally binding contract between the bidder and CLE Art as well as between seller and CLE Art, is formed when a bidder makes the highest bid and the online auction is closed. When the auction closes, the highest bidder (referred to herein as the "Buyer") shall pay for the item(s) purchased immediately. If, within seven (7) days of the auction, Buyer does not pay for and remove the item(s), or contact CLE Art and make alternative arrangements approved by CLE Art, CLE Art may resell the item without notice. If an item is resold for an amount less than the original, highest successful bid, the Buyer is obligated to pay the difference. If full payment is not made by the end of the applicable removal period, the Buyer's bidding privileges may be revoked and suspended from any other CLE Art until such time that the "open" invoice has been paid in full, regardless of whether an item has been resold. CLE Art reserves the right to forward all outstanding invoices for collection and/or legal action. Buyer is responsible for any and all costs incurred in the collection and/or enforcement of any contract and subsequent invoice. All bidders must be at least 18 years of age in order to register and bid. All items are sold "AS IS, WHERE IS", with no warranties or guarantees, expressed or implied. Illustrations, pictures or video's and descriptions posted on CLE Art or Live Auctioneer's or any other website or media are for the convenience of our Buyers and no other purpose. Buyer assumes complete and sole responsibility for inspection of items prior to bidding and relies solely on his or her own inspection as to condition and value of items and not upon any representation, description, or nomenclature of CLE Art. Buyer waives any and all claims against CLE Art, its agents, employees, officers and sellers, based on the condition, description and/or value of items. Condition reports may or may not be included in auction descriptions. The presence of any condition report is not guaranteed complete and the absence of any condition report does not guarantee item(s) is / are without damage, flaws, restoration, etc. Any Buyer may request that CLE Art provide a detailed condition report. CLE Art will make every effort to provide an accurate description of any characteristics the Buyer may request, however, such report is not guaranteed and CLE Art will not be held responsible for omissions or errors in any report. CLE Art reserves the right to refuse any bidder registration, any individual bid and to withdraw any lot at any time without liability to bidders, potential bidders, buyers or sellers. Buyer is solely responsible for the removal and/or shipping of all items and all costs related thereto. Buyer shall arrange with a third party shipper of Buyers' selection to have items picked up or shipped by the date and time identified for removal. CLE Art is happy to provide names of local shippers upon request. CLE Art makes no guarantee nor preference regarding third party shippers and Buyer assumes all risk and liability regarding pick up and/or shipping of items. Payment of invoices is due immediately. All payments must be received within seven (7) days of auction. CLE Art accepts personal checks, money orders, cashier's checks and wire transfer as acceptable forms of payment. Paypal may be accepted on invoice totals less than $500.00 on a case by case basis. CLE Art reserves the right to hold any and all items, refuse to release any items to any Buyer and/or their designated shipper until CLE Art, at its sole discretion, is satisfied such payment is good and legitimate.
