Sandpiper Studios Terms and Conditions of Sale 1. Acceptance of Terms. Purchase of any item from Sandpiper Studios whether in person, by phone or via internet indicates the purchaser’s agreement to be bound by these terms and conditions. Sandpiper Studios reserves the right to reject any sale, in its sole discretion, and to re-offer for sale any item upon rejection of any sale proposal. 2. Terms of Sale. Every item offered by Sandpiper Studios is sold “as is” and the Company makes no warranty or representation of any kind or nature with respect to the property. In no event shall Sandpiper Studios be responsible for the correctness of any description of any offered item, or of its genuineness, authorship, attribution, provenance, culture, source, origin, or condition. No statement of any kind made by Sandpiper Studios, or its agents, shall be deemed a warranty or representation of any kind, or any indication of assumption of liability. Photographs are of the actual item you will receive and we make every effort to provide a realistic depiction of the item offered for sale. However, as every item is sold “as is” no warranty, representation or assumption of condition or value should be assumed by the purchaser based on the photographs, and all such photographs are provided purely as a convenience for prospective buyers. All sales are final. No items are sold on approval. Placing a purchase is a legally binding obligation. There are no returns or exchanges. 3. Purchase Price and Payment. The “purchase price” of each item sold by Sandpiper Studios shall equal the actual sales price, and if applicable, sales tax. Total purchase price also shall include all packaging, handling, insurance and shipping costs. Purchasers may pay with Paypal or wire transfer. Sandpiper Studios reserves an absolute right to hold every purchased item until payment has “cleared and finalized” to Sandpiper Studios’ sole satisfaction. 4. Shipping. Upon the request of the buyer, Sandpiper Studios will provide the shipment of purchased items. Shipment is generally made via USPS or UPS ground; such shipment methods usually result in delivery to buyer within two weeks after payment has been received. Unless purchaser give special instructions and is prepared to pay for special handling and treatment, any shipping method chosen shall be at the sole discretion of Sandpiper Studios. Sandpiper Studios will make every effort to ensure that each sale item is packaged for shipment in accordance with commercially reasonable standards, but no liability is assumed for packaging method employed by Sandpiper Studios. Sandpiper Studios is in no way responsible for the acts or omissions of any independent handlers, packers or shippers of purchased items, for any loss or damage or delay from the packing or shipping of any property. Sole responsibility for any loss or damage with regard to any purchased item, shall pass to the purchaser at the time the purchased item is placed in the hands of the packager/shipper. 5. Limitation of Liability. If for any reason Sandpiper Studios is unable to deliver a purchased item in a condition fully satisfactory to purchaser, or should any purchased item be stolen, mis-delivered or lost during transit, Sandpiper Studios shall not be liable for any amount in excess of that paid by the purchaser for the purchased item. 6. Remittance of Payment. Should payment in a method acceptable to Sandpiper Studios in its sole discretion, not be received within a ten day period, the sale shall be considered cancelled and item may be relisted and made available for purchase. 7. Choice of Law. Should any dispute arise between Sandpiper Studios and any purchaser, said disputes shall be subject to the laws of North Carolina and Carteret County and shall be adjudicated with in that jurisdiction. 8. Entire agreement. The foregoing terms and conditions constitute the entire agreement for purchase between Sandpiper Studios and all customers. No modification of these terms will be valid or enforceable except by written agreement executed by both parties.
