Your bid is a contract. Bidder (or buyer, purchaser) agrees to be bound by all parts of the terms and conditions of auction sale. If you are the successful bidder, you have entered into a legally binding contract to purchase the lot from Cyrus Inc. Failure to acknowledge and/or abide by the terms and conditions, after a bid or bids are placed (or sale concluded), is no excuse for any post auction sale actions on the part of the bidder towards the auctioneer, auction house, Cyrus Inc., or any consignor. All items are sold to the highest bidder as acknowledged by the auctioneer. The auctioneer has the right to reject any bid; to advance the bidding at his discretion; or, in the event of a dispute between two bidders, determine the successful bidder; or re-offer / resell the lot in dispute. Cyrus Inc.is committed to inspecting and accurately describe all items, but all items offered for sale are ?as is? with no returns accepted. All sales are final. It is the bidder?s responsibility, whether bidding by absentee, phone, email or online to determine the condition of the items. Item descriptions are for reference only and are no guarantee to the exact condition or age of any items. No statements in the catalog, invoice, online or by a Cyrus Inc. employee can be deemed to be a warranty or assumption of liability with respect to condition, age, size, weight, importance or provenance of any of the items. Prospective Bidders should investigate a lot thoroughly before bidding. By bidding, the bidder acknowledges that they have investigated the lot to his or her satisfaction, or, that bidder has chosen not to do so, and agrees to accept the lot being bid on with no objections after the sale closes. Cyrus Inc. reserves the right to accept or reject any bid for any reason whatsoever, at any time before or during any auction. Any and all bids made by a bidder constitute an irreversible offer to purchase the lot at the maximum bid amount of the bidder and may not be withdrawn by the bidder under any circumstances. At the close of any auction, Cyrus Inc. has the final authority to determine the actual winning bidder of any lot. In the event of non-payment by the winning bidder, it is Cyrus Inc.?s sole discretion to either reoffer the lot to any other bidder, reoffer the lot in a future auction, or return the lot to its original consignor. In the event of any dispute between bidders, or in the event of doubt on Cyrus Inc.?s part as to the validity of any bid, Cyrus Inc. will have the exclusive final discretion to determine the successful bidder, cancel the sale, sell the lot to the next highest bidder or reoffer / sell the lot in dispute. Bidder understands and acknowledges that Cyrus Inc. pays independent online auction hosting venues for the hosting of their online sales. Cyrus Inc. cannot be held accountable if there are any problems, difficulties or issues bidder has with the placement or recording of bidder?s bids. Under no circumstances is it the responsibility of Cyrus Inc. regarding any error in the bidder?s bid, bidder?s computer, bidder?s ISP or online hosing venue. Bidder agrees to allow Cyrus Inc. to retain bidder's payment/credit card information, once provided for any auction, for collecting payment after auction close and invoices are sent. Absentee and phone bids are accepted and will be handled as a courtesy to the potential buyer. Cyrus Inc. is not responsible for any errors or failure to execute bids. Payment of the winning bid amount, buyer's premium and shipping/handling charges (if applicable) will be made after the auction closes and invoices have been processed. Items must be paid for within 10 days of date of auction, unless prior arrangements have been made with Cyrus Inc. ***ANY PAID ITEMS NOT PICKED UP WITHIN 90 DAYS BECOMES CYRUS INC. PROPERTY*** CONDITION Please inspect items or request a condition report prior to bidding. Failure to inspect a lot or ask for condition prior to bidding is no excuse for return. Condition requests or additional photography should be made prior to bidding and can be made by contacting Cyrus Inc. All condition reports are given as a courtesy to the potential bidder and are the opinion of Cyrus Inc. Absence of condition on any lot does not imply that the lot is free of imperfections. All sales are final and all lots are sold ?as is?. There are no returns or exchanges. Bidders are required to register with proper identification prior to auction. By participating in any auction, bidder agrees to Cyrus Inc.?s terms & conditions. PRICE ESTIMATES High and low estimates are provided solely for comparison purposes and Cyrus Inc. makes no warranties of any kind relating to them. Any appraisals or evaluations provided are solely for the convenience of the bidder and Cyrus Inc. makes no warranties of any kind relating to them. No price estimate or appraisal value should be considered to represent the investment or resale value of the item. BUYER?S PREMIUM A Buyer's premium of 18% will be added to the hammer price/winning bid amount. PAYMENT The bidder/purchaser is legally responsible for payment. Payment is due within 10 days of auction close. Items will not be released, for any reason, prior to full payment being received. Items not paid for or picked up within 10 days are subject to storage fees of $10 per lot/per day, unless arrangements have been made with Cyrus Inc. ***WE DO NOT ACCEPT PAYPAL*** Payments by credit card (Visa, Mastercard, Discover) are accepted for UNITED STATES customers ONLY. Other accepted forms of payment include, cash, cashier?s check, certified check, money orders, bank wire transfers, and approved personal checks (returned checks incur a $25 fee). Cyrus Inc. reserves the right to hold any property until check/payment clears. RETURNS All sales are final and all lots are sold ?as is?. There are no returns or exchanges. SHIPPING Buyer pays shipping and handling costs. We provide shipping, handling, packing and insurance for ALL items sold by us. There is a $20 FLAT RATE fee for ONE item, up to an UNLIMITED amount of items purchased during ONE particular auction. This $20 fee will be added to the total invoice amount. All items are shipped to confirmed addresses only. If paying by credit card; billing and shipping addresses MUST MATCH or we reserve the right to REFUSE shipping. International buyers are welcome to bid, but please contact Cyrus Inc. for further details of payment and shipping. Cyrus Inc. does NOT allow currier services to pick up any items. Items picked up at our location in Monroe, New York, will only be released to the buyer if their information matches the name and information used when signing up to bid. Customers picking up their purchased items must provide a valid form of identification and valid phone number. No items will be shipped to any bidder for any particular auction until all charges for the auction have been paid in full and all funds have cleared. Even if paid in full, no items will be shipped to any bidder for any particular auction if the bidder has any open balances with Cyrus Inc. BY BIDDING, THE BIDDER AGREES TO CYRUS INC.?s SHIPPING AND HANDLING POLICY AND CHARGES. BIDDER FURTHER AGREES THAT NEITHER DELIVERY OF AN ITEM AFTER THE DATE DESIRED OR EXPECTED BY BIDDER OR LOSS OF AN ITEM BY A THIRD-PARTY DELIVERY ENTITY GIVE RISE TO A CAUSE FOR A CHARGEBACK CLAIM AND BIDDER SPECIFICALLY AGREES TO REFRAIN FROM THE FILING OF ANY SUCH CLAIM. TAXES Winning bidders are required to pay New York State sales tax of 8.125% in addition to the hammer price and buyer?s premium; unless a valid tax exemption number (NOT EIN Number) is provided or the items are being shipped out of state. Items purchased outside of NYS, which are picked up in NYS, are also subject to sales tax unless a valid tax exempt number is provided.
