The user of Live Auctioneers indemnifies and holds the Auction House and its consignors harmless against any claim arising out of or resulting from your use of the Live Auctioneers site, including all losses, damages, liabilities, and all fees (including attorney?s fees), costs, and expenses incurred in connection with any claim. Under no circumstances, including, but not limited to, negligence, shall the Auction House and its consignors be liable for lost profits or any special, incidental, or consequential damages that result from the use of or the inability to use, this site. Some of the lots in this sale are offered subject to a reserve. The reserve is a confidential minimum price, below which the lot will not be sold. In most cases, the reserve will be set below the estimated range, but in no case will it exceed the estimates listed. A representative of the Auction House will execute such reserves by bidding for the listing agent. In any event and whether or not a lot is subject to a reserve, The Auction House may reject any bid or raise not commensurate with the value of such lot. All property is sold ?as-is? and the Auction House makes no warranties or representation oF any kind or nature with respect to the property, and in no event shall they be responsible for the correctness, nor deemed to have made any representation or warranty, or description, genuineness, authorship, attribution, provenance, period, culture, source, origin, or condition of the property and no statement made at the sale, or in the bill of sale, or invoice, or in the catalog, or elsewhere shall be deemed such a warranty of representation or an assumption of liability. Prospective buyers are urged to inspect those lots in which they have an interest. The highest bidder as determined by Auctioneer (Live Auctioneers LLC) shall be the purchaser. In the case of a disputed bid, the auctioneer shall have sole discretion in determining the purchaser and may also, at his or her election, withdraw the lot or reoffer the lot for sale. The auctioneer shall have sole discretion to refuse any bid, or refuse to acknowledge any bidder. A buyer's premium of 15% of the hammer price will be added to each purchase to reach the total sales price. The total sales price is subject to applicable sales tax. Mississippi residents will pay all applicable taxes unless a tax exemption form is on file. Acceptable forms of payment are cash (in house only), VISA, MasterCard, American Express, Discover, and PayPal. Invoice must be paid in full upon receipt. Auction House reserves the right to hold merchandise purchased until the funds have cleared. Collection of Property and Storage Charges: The buyer will pay for the purchased property immediately upon receipt of invoice and arrange to remove it from the premises of the Auction House within seven (7) days of the sale. We are not responsible for any damage or loss on property purchased but not removed from premises. If the purchased Property is not removed within seven (7) days of the sale, the buyer will thereafter be assessed a $10 per lot storage charge per day which must be paid in full prior to releasing merchandise. The Auction House may, at its discretion, remove the purchased Property to public storage at the buyer's risk and expense. All associated charges will be added to the total invoice and must be paid in full before the Property will be released. Under no circumstance will an item be stored longer than 30 days. Any item not picked up within 30 days will be considered abandoned merchandise and will become the property of Blue Rose, LLC If the purchaser breaches any of its obligations under these Conditions of Sale, including its obligation to pay in full the total sales price of all items for which it was the highest successful bidder, Blue Rose, LLC may exercise all of its rights and remedies under the law including, without limitation, (a) canceling the sale and applying any payments made by the purchaser to the damages caused by the purchaser?s breach, and/or (b) offering at public auction, without reserve, any lot or item for which the purchaser has breached any of its obligations, including its obligation to pay in full the purchase price, holding the purchaser liable for any deficiency plus all costs of sale. Purchasing items, registering, or any forms of communication with the auction allows use of emails and/or other information strictly for auction promotional & communication uses. Information is used solely for Blue Rose, LLC. Bidding on any item indicates your acceptance of these terms and all other terms printed within, posted, and announced at the time of sale. All sales are final and no refunds will be granted.
