By registering to bid and/or submitting any bid, you acknowledge and accept these Terms and Conditions of Sale. Thank you for your interest in bidding with us! MERCHANDISE OFFERED Lot announcements, listings, photographs, and catalog information are for descriptive purposes only. Condition details are offered as a courtesy to bidders, and are opinions only, not statements of fact, and do not imply any warranty concerning the condition, or any assumption of liability. The absence of a condition report does not imply that the lot is perfect or free from wear, flaws, or characteristics of age. Bazzle's Fine Art Auction is not responsible for errors and/or omissions of the condition. Buyers are encouraged to request condition reports and/or additional photos before bidding. All items are offered at auction, with no reserves or minimums, unless otherwise specified. All announcements made on the day of the auction supersede any other previously announced or published materials. LIVE AUCTIONEERS/INVALUABLE REGISTRATION and BIDDING All auctions are conducted through Live Auctioneers and Invaluable. At this time we are not accepting phone bidders. Bidders must register with Live Auctioneers and/or Invaluable directly in order to be approved for bidding in an auction. In order to be approved for bidding, Bidders may be asked to provide Bazzle's Fine Art Auction with a valid VISA/MasterCard or Government issued ID to be approved for bidding. BIDDING The highest bidder for each lot shall be the buyer of the offered lot. By bidding, you agree to pay for the lot in full and assume full risk and responsibility for the lot, if deemed the highest bidder. The purchaser, or highest bidder, upon bidding, agrees to all terms and conditions listed here and also agrees to sign a confirmation of purchase if requested. In the event of a tie between bidders, Bazzle's Fine Art Auction holds the final say in determining the successful bidder. In the event of a tie between an absentee bidder and a live bidder, the lot will be granted to the live bidder. If any dispute arises in regards to lots purchased, or in the event of a tie between two or more bidders, Bazzle's Fine Art Auction has the right to offer the lot to the next highest bidder. The bidder is personally responsible for any and all bids made from his or her account regardless of circumstances under such bid was made. This also includes any bidder that is representing a purchaser. Bazzle's Fine Art Auction reserves the right to deny a bid from any bidder. If a lot is subjected to a reserve when offered, Bazzle's Fine Art Auction may bid on behalf of the consignor, open the bidding at the select amount, repeatedly bid, or bid in response to other bidders to achieve the set price. Consignors shall not be permitted to bid on their own items. ABSENTEE BIDS Bazzle's Fine Art Auction accepts Absentee bids, however, at this time we are not accepting phone bids. All absentee bids are executed in a competitive manner, however, if there is a tie between a live and absentee bid, the winning bid will go to the live bidder. Absentee bidding is a service we offer for the convenience of our customers. Although we make every effort to execute your bid(s), Bazzle's Fine Art Auction is not liable for any errors or omissions. We will notify successful Absentee bidders via email after the auction. Bidders may be required to provide a valid VISA/MasterCard and/or Government Issued ID order to be approved for bidding. BUYER?S PREMIUM, SALES TAX, and INVOICES A Buyer's Premium of 20% will be added to each successful bid. The buyer?s premium amount is stated on each applicable auction page and is non-refundable. Delaware does not have state sales tax, therefore none will be applied to the sale. Invoices will be sent out within 48 hours of the auction. PAYMENT Once an invoice is sent, the winning bidder has one week to complete the purchase. If the purchase is not completed within one week, a dispute will be opened and a force charge will be made on the credit card provided at registration. If no credit card was provided, Bazzle's Fine Art Auction has the right to relist the lot or offer it to the next highest bidder. If you submit your bid using our absentee form, you authorize Bazzle's Fine Art Auction to charge your credit card for all successful bids, including buyer?s premium and applicable sales tax immediately following the auction, unless you notify us in writing prior to the auction start time that you will be making alternate payment arrangements. PACKING AND SHIPPING No item will be shipped until full payment has been made. Once payment is received, items will be shipped out within 7 days. Bazzle's Fine Art Auction will provide a shipping estimate from USPS with each invoice as well as a packing fee. If the buyer chooses to forego USPS shipping, a new invoice will be sent. Buyers, at their discretion, may choose to use a third party shipper and agrees to pay for and arrange to ship with their chosen shipper. The packing fee will be charged regardless of whether the buyer chooses a third party shipper. All shipping, packing, and handling costs are the responsibility of the buyer. Bazzle's Fine Art Auction does not offer a 'pick-up' option. RETURNS AND AUTHENTICITY All items are sold as is. We encourage you to examine all items carefully and bid according to your own expertise. Bazzles Fine Art Auction guarantees the authorship of a lot, based on the best of our knowledge, for 30 days from the date of receiving the item, and only to the original purchaser on record of the lot. The original purchaser must have remained the owner of the lot without transferring the lot to a third party. All guarantees stated herein apply only to the purchaser of the item(s) on the invoice issued by Bazzle's Fine Art Auction and are non-transferrable. If the authenticity of any lot is questioned, the purchaser will be required at least one statement from an accredited expert, neutral to the purchaser and auction house, in the given field. Statements of inauthenticity must include an official letterhead, state the lot(s) in question, and be signed and dated to be deemed acceptable. This will be done at the purchaser?s expense. If an item is deemed inauthentic, Bazzle's Fine Art Auction will issue a refund equal to only the hammer price of the item. Shipping and handling costs, along with any applicable taxes, and buyers premium are non-refundable. Returned lots must arrive in the same condition the purchaser received it, and must be returned within one week?s time of the determination of inauthenticity. It is the buyer's responsibility to insure all items for their full value and cover the cost of returned shipping regardless of the reason for return. Refunds will not be processed until Bazzle's Fine Art Auction is in possession of the item(s) in question. Refunds will not be issued based on physical condition, provenance, or COAs if the bidder did not request the needed information regarding the piece before the start of the auction. All content, including but not limited to photos, condition reports, and any additional information that ia provided by Bazzle's Fine Art Auction is a courtesy and shall not be duplicated or published elsewhere without the consent of Bazzle's Fine Art Auction.
