STANTON’S AUCTIONEERS TERMS & CONDITIONS PLEASE READ ALL THE TERMS AND CONDITIONS BEFORE BIDDING WITH STANTON’S AUCTIONEERS. ALL WHO BID IN A STANTON’S AUCTIONEERS EVENT ARE BOUND BY THESE TERMS AND CONDITIONS. TERMS OF SALE When bidding on any lot offered by Stanton’s Auctioneers, the bidder indicates acceptance of the following terms and conditions. Participation in the auction binds you to agreement of these terms whether you have read or understand said terms. CONDITION OF ITEMS Stanton’s Auctioneers makes every attempt to describe all items accurately and to identify any flaws that may affect the value of the item. Final determination of the condition of any item, however, is the buyer’s responsibility. We will do our best to properly describe the items being sold and the condition they are in when a party contacts us directly for information regarding an item. All items, however, are being sold in AS IS condition and final responsibility falls upon the buyer. Please email stevenestanton@gmail.com for a condition report and photos, if desired. Emails should be received at least 48 hours in advance of the auction. The auctioneers and the seller are not responsible for errors and/or omissions in the catalog, online listings, website, social media or any other supplemental materials, whether written or verbal. BUYER’S PREMIUM A 23% buyer’s premium for online bidders using the LiveAuctioneers platform. Phone bidders will be charged 18%. The premium charged to on-site bidders is 10%. The amount will be added to the purchase price of the item. A charge of 3% will also be added for persons paying with a credit card. PAYMENTS Invoices will be sent by email to LiveAuctioneers and absentee bidders. All unpaid invoices with LiveAuctioneers will be charged to the credit card on file with LiveAuctioneers 72 hours after the auction ends subject to the LiveAuctioneers credit card processing fee. All invoices must be paid within 10 calendar days after the close of the auction unless other payment arrangements have been made. Michigan sales tax of 6% will be charged to all buyers unless the buyer provides Stanton’s with a current sales tax exemption license or the item is being shipped out of state. Checks should be made payable to Stanton’s Auctioneers and mailed to 144 S. Main, P.O. Box 146, Vermontville, MI 49096. All payments must be received within 14 days following the auction. We accept credit card payments in the form of MasterCard and Visa. SHIPPING It is the buyer’s responsibility to take shipping costs into consideration when placing bids. Winning bidders are responsible for all costs to ship the items including the cost of insurance. Shipping is not included in the price of your auction items. Your items will be taken to a shipper who will contact you with the costs involved in shipping the items to you. BIDDER REGISTRATION If you are attending the auction, you may register to bid during the preview or on the day of the auction. We will need your driver’s license to complete the registration. If you are bidding on LiveAuctioneers.com, registration is required at least 48 hours in advance of the auction. By registering for an auction, you agree to all terms and conditions, BIDDING INFORMATION Anyone bidding at our auctions agrees to pay for all lots for which they are the winning bidder. Each lot in the auction is given a low and high estimate representing the range of value which is Stanton’s conservative auction evaluation. The actual prices realized can fall below or above this range. An estimate of the selling price should not be relied upon as a statement that this is the price at which the item will sell or what its value of the actually may be. If identical absentee bids are left on an item, the first bid received will take precedence. Stanton’s Auctioneers reserves the right to withdraw any property before the completion of the sale and will have no liability for doing so. Stanton’s reserves the right to accept or decline any bid. Bids must be for the entire lot and each lot constitutes a separate sale. All bids are per lot unless otherwise announced at a live sale by the auctioneer. The lots will be sold in their numbered sequence unless the auctioneer directs otherwise. For live auctions, the auctioneer will have the final discretion if any dispute should arise between bidders. The auctioneer will determine the successful bidder, cancel the sale or re-offer to sell a lot or lots in dispute. Stanton’s Auctioneers will have the final discretion to resolve any disputes arising after the sale and in online auctions. If any dispute does arise, our sale record is conclusive. Subject to the conditions set forth, on the fall of the auctioneer's hammer, title to the offered lot will pass to the highest bidder acknowledged by the auctioneer and the bidder will assume the full risk and responsibility for the item and will immediately pay the full purchase price. If any part of the Terms & Conditions is found by any court to be invalid, illegal or unenforceable, that part shall be discounted and the rest of the conditions shall continue to be valid to the fullest extent of the law. We reserve the right to amend our terms and conditions at any time without notice.
