ALL INTERNET BIDDERS ARE REQUIRED TO READ AND AGREE TO THE FOLLOWING CONDITIONS OF SALE. 1. You must be registered at least 24 hours in advance of the start of the sale in order to participate. 2. The Buyer's Premium is 25% for all internet purchases. 3. We provide In-House shipping and packaging. Due to quality control issues, we do not release to third party shippers. Buyers may request a shipping quote (estimate) prior to auction. 4. The absence of condition remarks in the lot description DOES NOT mean the item is in perfect condition. All items are sold AS IS and there will be no returns based on condition. 5. Registered bidders accept all personal liability to pay the purchase price, including the buyer's premium and all applicable taxes, plus all other applicable charges, unless it has been explicitly agreed in writing with Newmoons X&W before the commencement of the sale that the bidder is acting as agent on behalf of an identified third party acceptable to Newmoons X&W, and that Newmoons X&W will only look to the principal for payment. 6. Auctioneer reserves the right to withdraw any property before the sale and shall have no liability whatsoever for withdrawal of property. 7. Auctioneer reserves the right to reject any bid. If lot carries a minimum reserve, the Auctioneer may bid up to the reserve on behalf of the buyer. The highest bidder acknowledged by Auctioneer will be the Buyer. In the event of a dispute between bidders, Auctioneer has final discretion to determine the successful bidder. 8. If any applicable conditions herein are not complied with by the Buyer, in addition to other remedies available to Auctioneer and the Consignor by law, including without limitation the right to hold the Buyer liable for the total purchase price, Auctioneer at its' option may either (a) cancel the sale, retaining as liquidated damages all payments (including deposits) made by the Buyer or (b) resell the property either privately or at public auction without reserve & in either event the Buyer will be liable for any deficiency in the purchase price & all costs & expenses, including: storage fees, handling charges, the expenses of both sales & commissions on both sales at Auctioneer's regular rates, all other charges due here-under, including attorney fees & incidental damages. In addition, a defaulting Buyer shall be deemed to have granted Auctioneer a security interest in, & Auctioneer may retain as collateral security for such Buyer's obligations to use, any property, in Auctioneer's possession owned by such Buyer. 9. Auctioneer undertakes the execution of absentee bids as a convenience for clients and is not responsible for failure to execute bids, or for any error in the execution of bids. 10. The Buyer's sole and exclusive remedy is the rescission of the sale and the refund of the original purchase price plus any Buyer's Premium made, and is in lieu of any other remedy that may otherwise be available as a matter of law or in equity. Auctioneer and Consignor shall not by liable for any incidental or consequential damages incurred. -PAYMENT- *IMMEDIATE PAYMENT IS REQUIRED* A 25% buyer's premium is added to the hammer price of each item sold for internet live buyers. We accept payment via Paypal or Bank Wire Transfer ONLY. Payment made by irrevocable wire transfer WILL incur a processing fee. Credit cards is not acceptable and for paypal user a surcharge will be assessed. All properties must be paid within 7 (seven) days. Any invoice not paid within 20 (twenty) working days will be deemed as nonpayment. In the event of nonpayment, the lot(s) in question may be resold or returned to the owner. -CONDITION OF LOTS- All items are sold AS IS and there will be no returns based on condition. The items sold are often of considerable age and will exhibit wear, usage and damage often not listed in the catalog entry. The absence of condition remarks in the lot description DOES NOT mean the item is in perfect condition. Prospective buyers are in ALL CASES responsible for determining the physical condition of lots. Condition reports are available upon request (email us at sandrowjw@gmail.com). Therefore, if a prospective bidder has not examined the property to their satisfaction before the sale, or his/her agent has not inspected the property, Newmoons X&W recommends that they not bid on the property. -CONDITION REPORTS- Please note that Newmoons X&W is pleased to provide our opinion of the condition of items offered for sale upon request. This service is provided for guidance only, without legal obligation. We are not professional conservators or restorers, and therefore cannot guarantee the content of the written condition report. Subsequently, if a prospective buyer has not examined the property to their satisfaction before the sale, or his/her agent has not inspected the property, Newmoons X&W recommends that they not bid on the property. Notwithstanding this report of condition, all lots are offered and sold AS IS and there will be no returns based on condition in accordance with the "Conditions of Sale" as listed. -SHIPPING AND/OR REMOVAL OF PROPERTY- A shipping price is included on your invoice calculated to the address listed on your invoice. Please indicate any special shipping instructions or different ship-to address immediately after the auction. The shipping price includes only insurance (optional), shipping cost and any physical materials consumed during packaging and shipping. (For international shipments buyer is responsible for all duties, customs, and taxes, which are NOT included in the shipping price). Newmoons X&W won't charge extra fee aside from what was stated above. Postal service (EMS) is preferred for international shipping. SF Express International is not available for certain types of mechandise. Please contact immediately after the auction if you want to use SF Express or other logistic vendors like DHL, Fedex, etc. Please note that shipping after an auction is done in the order payment is received and cleared - because of this, shipping times may be 4-6 weeks post payment. Please note that ivory artifacts trading is strictly banned within China, regardless of their age. Newmoons X&W won't sell or ship any ivory items. In the event that items need to be stored over 30 days, storage charges may apply at a rate not to exceed $10 per lot/per day. Purchaser agrees that after 60 days after the date of the auction, if the purchased merchandise has not been removed or other arrangements have not been authorized by Newmoons X&W personnel in writing, the merchandise shall be sold at auction at no reserve. All costs of notice, advertising, commissions, the sale and additional storage fees per lot at $10.00 per day will be assessed against the proceeds of the sale. Any funds remaining after the resale of the items and payment of auction fees and storage fees will be distributed as required by law. -RETURN- Under following dipute conditions, an item can be returned by a purchaser with all his money reimbursed, including the item price and buyer's premium: 1. In the event of an authenticity dispute, a written letter from a recognized expert in the field pertaining to the item in dispute must then be presented. A written notification of the dispute must be provided to Auctioneer within 20 (thirty) business days from receipt of the item. 2. In the event of an error in item description, provenance, or dimensions, a written letter on the error must be provided to Auctioneer within 20 (thirty) business days from receipt of the item. 3. Any reason other than the above, a notification must be provided to Auctioneer within 7 (seven) business days from receipt of the item. If notification is given after seven days, the Auctioneer may consign the item for a future sale. All items to be returned must be adequately insured and must be received by Newmoons X&W in the same condition as when shipped. In no event may any item be returned after 90 days from the date of delivery. There will be NO returns based on condition.
