Terms & Conditions Welcome and thank you for participating in a Marlin Art Auction! Our Buyers must accept the following Terms & Conditions to participate in our auctions. By signing up as a bidder, you acknowledge that you have read and understood our Terms & Conditions and agree to abide by them. Please note that sizes provided are the FRAMED DIMENSIONS unless otherwise noted. We hope that you have a great experience and feel confident bidding in the auction! Total Sales Price- The total sales price of an item includes the hammer price plus a 21% buyer's premium. Packing, shipping, and insurance is extra. For payment, if you have a card on file with LiveAuctioneers, it will be automatically charged 72 hours after you receive your invoice. Any buyer that does not make payment will automatically be blocked from future auctions and will be filed with a collection agency and the credit bureau. Shipping costs for continental USA are as follows? Framed Art Size: 13" x 13" or smaller: $30 Framed Art Size: 23" x 23" or smaller: $40 Framed Art Size: 29" x 33" or smaller: $55 Framed Art Size: 36" x 48" or smaller: $95 Unframed Art: $35 Framed art with outside dimensions larger than 36" x 48" and/or any shipments outside of the Continental USA are subject to additional shipping charges which will be calculated and added to your final invoice. Please look at the images and description before you place a bid. Items are sold As-Is- please see descriptions and images in each individual lot. Framing for unframed artwork is not included. Under certain circumstances, we may make an exception and allow a cancellation, return or approve a refund. However, in the case of a return, the Buyer's Premium and Shipping Cost will not be refunded. In the event, an item is received damaged due to common carrier handling; Marlin will work with the customer to fairly reconcile the situation as quickly as possible. Right to refuse sale -We reserve the right to refuse any sale due to unforeseen circumstances including, but not limited to: damage to an item, out of stock listing, misrepresented item, withdrawn consignment, or other such issues. In the event of a refused sale for which payment has already been received, a full refund will be issued equal to the purchase price of the given piece. Winning Bid-The highest bidder shall be the Buyer. Any buyer that does not make payment may automatically be blocked from future auctions and a notification may be filed with a collection agency and credit bureau. Withdrawal prior to Sale- Marlin reserves the right to withdraw any property before the sale, and shall have no liability whatsoever for such withdrawal. All starting bids and estimates are subject to change before the start of the auction. Contact- By signing up to bid with us, you consent to allow us to contact you via email, or phone about this auction, upcoming auctions, and to discuss any and all purchases. Guarantee- All items in the catalogue are sold as described and as is and all sales are final. Buyer has the right to contact us if the item is not as described. For all purchased limited edition items offered in this auction, please note that the item received may be a different number in the edition than the one seen in the photographs provided. We certify that all information is correct to our knowledge. We reserve the right to cancel any sale. Online Catalogue- All listings, including reserves and starting prices and low and high estimate, are subject to change. You agree to indemnify, defend, and hold harmless Marlin Art and its employees, successors, officers, from and against any and all claims, demands, losses, damages, liabilities, costs and expenses (including attorney fees) arising out of or relating to any claim or action based upon your use of Online bidding services or the breach of this Agreement. If you have not contacted Marlin Art to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
