TERMS OF SALE These Terms of Sale set forth the terms and conditions on which Heirloom Art Gallery ('we' or 'us') sells properties in lots in this catalog. You agree to be bound by these terms by registering to bid and/or by bidding on our auction. If you do not agree to each term of this agreement, are unwilling to accept this agreement, or if you do not have the legal authority to accept and agree to this agreement, you may not use the Website or conduct a transaction with or through us. i.e. bidding at auction, buying goods from us, etc. All sales are final and we auction all items as is. HEIRLOOM ART GALLERY MAKES NO WARRANTY OF MONEY-BACK OR WARRANTY, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, OF ANY NATURE WITH RESPECT TO THE LOTS OFFERED AT ANY HEIRLOOM ART GALLERY. EACH AND EVERY LOT IN EACH AUCTION AT THE HEIRLOOM ART GALLERY ARE FINAL, SELL ""AS IS" AND "WHERE AS IS" WITH NO REFUND, NO EXCHANGE AND NO STORE CREDIT. WHERE THERE ARE NO WARRANTIES OF ANY KIND. Ignorance of terms by buyer is no excuse to bring action against the auction house. Neither Heirloom Art Gallery nor the consignors make any warranties or representations, express or implied with respect to such lots. Buyers are strongly advised to personally examine any property in which they are interested before the auction takes place. While Heirloom Art Gallery has attempted to adequately describe each lot to be sold, such representations merely reflect our opinion and are superficial in nature. You acknowledge that errors may include, but are not limited to, the catalog or its contents, the lot description or other physical condition descriptions, the accuracy of the photographic image used in the online lot description, the importance, age , size, authorship, origin, attribution, authenticity, importance, exhibitors or provenance of any lot contained therein, so Heirloom Art Gallery will not be responsible for such errors or omissions. All measurements are approximate and auction house makes no warranties, express or implied, as to the merchantability or fitness for any purpose except as otherwise expressly stated in this Terms and Conditions. In addition, the absence of a description of an item or the failure to note a defect on an item does not imply that the lot is in perfect condition or free from wear, defects, modification, alterations, or other imperfections. Unless otherwise noted, some lots may show some wear, scratches, missing stitches, or other blemishes due to age and use. No statement made by us, whether written or oral, shall be construed as a warranty, representation or condition. No sale will be voided because of any imperfection, regardless of whether it has been noted. Each lot is sold "AS IS", "WHERE IS", "WITH ALL FAULTS". Heirloom Art Gallery reserves the right to reject any offer. Our company reserves the right to accept or reject a bidder to participate in the auction. The auctioneer is not responsible for variations in the appearance of the photos online. Heirloom Art Gallery does not guarantee that a buyer will acquire any copyright, trademark or reproduction rights related to any lot purchased. We do not guarantee the authenticity of any previously made label or stamp appearing on the back, front or frame of a lot, nor the authorship of any of the documents included to the lot. No additional information regarding provenance will be provided after the auction. Authentic is not reason for return. Signed [Artist Name]: In cases where the signature appears in the lot, the work is described as-is with no attributions given. This lot may be attributed or style-of. By [Artist Name]: The work is by the artist. Attributed to [Artist Name]: The work may be ascribed to the artist on the basis of style, but there may be some question as to actual authorship or it could also be done by an unknown hand. Manner of [Artist Name]: The work was executed by an unknown hand but was designed deliberately to emulate the style of the artist. After [Artist Name]: The work was executed by an unknown hand but is a deliberate copy of a known work by the artist. Circle of [Artist Name]: A work of the period of the artist showing his influence, closely associated with the artist but not necessarily his pupil. Bidding normally begins with the initial starting price, usually low, but the final bid price may be lower or higher than any estimate. Regarding the estimated prices, for the convenience of our customers, we provide estimates of the value of the item that are simply that. These estimates are our approximate valuations only and should be taken as informed guesses based on comparable auction values, not "prices". Estimates do not include the Buyer's Premium. Estimates are subject to revision at any time and are not definitive. When making a bid on a live selling site, absentee bidding, by Internet, phone, a bidder accepts personal responsibility for paying the purchase price, including BUYER'S PREMIUM (payable by the buyer, and will form a lien and first security interest on any item purchased), all applicable taxes, and all other applicable charges. PAYMENT All items purchased in this auction must be paid for on the sale day. All items won through bidding must be paid for within three (3) business days of the sale date. If the buyer doesn't contact Heirloom Art Gallery within three (3) business days of the sale, the credit card used to secure the offer will be charged for the full amount of the invoice, which the bidder accepts pay. Buyers must pay for lots in US dollars. Heirloom Art Gallery accepts the following payment methods: Credit/debit cards VISA, MASTERCARD, AMERICAN EXPRESS, DISCOVERY, MONEY ORDER, PERSONAL CHECK, BANK WIRE TRANSFER. No payment combinations. Autopay This auction uses Autopay by LiveAuctioneers. If you place a winning bid, your card will be charged shortly after the conclusion of the auction. POSSIBLE AGREEMENT CHANGES These Terms & Conditions are effective as of the date listed at the end of this agreement, but are subject to revision by us at any time, without notice. Each time you transact with us or use our website, be responsible for reviewing the current terms of this agreement.

If you have not contacted Heirloom Art Gallery to arrange payment within 3 days of the time that invoice is sent, we will charge the credit card you used to register for the auction for the amount of your invoice.
